1. VALIDITY OF THESE TERMS AND CONDITIONS
These Terms and Conditions (the “Terms” or this “Agreement”) constitute a legally binding agreement between you (“Customer” or “you”) and TELE1 Ltd (trading as SIMzip), a company registered in the United Kingdom (Company Number: 15894612) and governed by the laws of the United Kingdom. SIMzip is a registered trademark of TELE1 Ltd (Trademark Number: UK00004173849). These Terms govern your use of our eSIM products (the “Services”), including any associated mobile application (the “SIMzip App”) and website (the “Site”), collectively referred to as the “SIMzip Services.”
By clicking “I Agree” (or similar) or by using or accessing the SIMzip Services in any way, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, you must not use the Services.
SIMzip reserves the right to accept or reject any variant clauses proposed by a Customer unless explicitly agreed to in writing. You are advised to check these Terms periodically as described in Section 24 below.
2. DESCRIPTION OF SERVICES
2.1 Use of the Services
SIMzip provides eSIM solutions to customers worldwide, offering data only connectivity
on devices compatible with eSIM technology. Unlike some mobile
operators, SIMzip does not offer or support monthly recurring plans; our packages
are typically prepaid or one-off purchases. Our goal is to ensure customers can
enjoy seamless connectivity without the need for a physical SIM card.
To use the Services, you must create a SIMzip account (an “Account”) using Google or Apple ID authentication. You agree to provide accurate, current, and complete information during registration and to keep your Account details up to date. You alone are responsible for all activities that occur under your Account. If you suspect unauthorised use, please contact SIMzip immediately.
2.2 Registration
All users who wish to access or use SIMzip Services, including but not limited to
end-users, business users, or those acting on behalf of third parties, must accept
these Terms. When registering, you may be asked for personal details (e.g. full name and
email) or, if registering as a business, relevant corporate details.
SIMzip may request additional information if necessary to improve or maintain
service quality, always in accordance with applicable data protection laws.
2.3 SIMzip Commitments
SIMzip strives to deliver reliable services but does not guarantee uninterrupted or
fault-free availability. We make reasonable efforts to minimise disruptions and
maintain service quality.
2.4 Customer Obligations
You must not use SIMzip Services in any way that is illegal, fraudulent, abusive,
or that damages or impairs SIMzip’s networks or systems. If we reasonably believe
you are in breach of these obligations, we may suspend or terminate your access to
the Services. During suspension, any charges that have accrued remain payable.
2.5 Device Compatibility
You are solely responsible for ensuring your device supports eSIM technology and
is network-unlocked. Please check the compatibility list provided at checkout.
If you confirm compatibility and later find the device is not suitable, SIMzip is
not responsible for such issues. The compatibility list may not be exhaustive and
may not reflect newly released devices.
3. START, DURATION, AND TERMINATION OF THE CONTRACT
Your contract with SIMzip begins when you complete a purchase through the SIMzip Site, SIMzip App, or any other platform authorised by SIMzip. You are responsible for activating any purchased eSIM in accordance with the instructions provided. Failure to activate an eSIM (if applicable) within the specified period may result in its expiration.
If you delete an eSIM from your device or have no active package, the contract ends in respect of that eSIM. In the case of business users with specific agreements, contract terms remain in force as defined in any separate commercial arrangement.
4. CHARGES AND PAYMENT
Payment for SIMzip eSIMs is handled by authorised payment service providers (“PSPs”). You may be required to register with the PSP, agree to their terms, provide necessary payment details, and complete any required verification. Unless stated otherwise, prices may be listed in pounds sterling (GBP), United States Dollar (USD), or Euro (EUR), and applicable taxes or fees may be added depending on your location.
4.1 Payment Methods
SIMzip accepts various forms of payment (e.g. credit/debit cards, Apple Pay, Google Pay, and other
PSPs). The specific currency and methods available at the time of purchase may
vary. We rely on reputable PSPs to process and secure transactions; by paying
through these providers, you consent to their handling of your data in accordance
with their terms.
4.2 No Monthly Recurring Plans
SIMzip does not offer monthly subscriptions or recurring billing cycles. All
eSIM purchases are one-off transactions or prepaid packages, ensuring full
transparency and no hidden recurring charges.
4.3 Invoicing (Business Users)
For authorised business users operating via the SIMzip partner platform, we may
invoice for credits used to acquire eSIMs, top-ups, or related services. Payments
must be made within the period indicated on the invoice. Late payment may result
in service suspension, imposition of interest, or other remedies as permitted by law.
4.4 Prepaid Transactions (Business Users)
Business users may load prepaid credits to their partner platform account (“SIMzip
Credits”), which can be used to purchase eSIMs or other SIMzip products. Credits
are non-refundable and remain the property of SIMzip upon contract termination,
unless otherwise agreed in writing.
4.5 Postpaid Transactions (Business Users)
Where approved by SIMzip, business users may be granted a credit facility to acquire
eSIMs or top-ups on a postpaid basis. Credit limits are assigned at SIMzip’s sole
discretion and may be unilaterally adjusted. Unauthorised exceeding of such limits
may result in service suspension or termination.
5. DELIVERY
Once purchased, your eSIM will appear in your SIMzip account (accessible via the Site or App). Business users will manage eSIMs via the SIMzip partner portal. A confirmation email or notification is typically provided post-purchase. Delivery of eSIM details may vary depending on the chosen integration method or platform.
6. REFUND, CANCELLATION, AND MODIFICATION POLICY
You may request a refund or eSIM replacement if you cannot use a purchased eSIM due to an error or omission by SIMzip, provided you notify us within thirty (30) days of purchase. Where feasible, SIMzip may first attempt to resolve the issue within ten (10) days of your notice. Should you fail to cooperate in reasonable troubleshooting, SIMzip may decline the refund. Once an eSIM is installed, it is generally deemed used and ineligible for a refund.
SIMzip will not compensate for costs incurred by using alternative SIMs, providers, or devices unrelated to your SIMzip purchase. If fraud or abuse of our policies is suspected, we reserve the right to deny refunds and may suspend associated accounts. For accidental or unauthorised purchases, please contact support immediately; approval of any refund is at SIMzip’s discretion.
Refunds approved by SIMzip will typically be credited back to your original payment method or, for business users, credited as SIMzip Credits or via a credit note. Please allow up to thirty (30) business days for refund processing by the relevant financial institution.
7. USE OF DIGITAL CREDITS (BUSINESS USERS)
From time to time, SIMzip may provide digital credits (“SIMzip Credits”) to business users. Credits are only valid for purchasing SIMzip products and services. Unused credits do not expire unless otherwise stated, but remain the property of SIMzip. Credits have no cash value and are non-transferable unless specifically authorised by SIMzip.
8. eSIM ACTIVATION
SIMzip implements an eSIM time-limited activation policy to manage resources effectively. You must activate any purchased eSIM according to the instructions and time frames provided at purchase. Should you fail to activate an eSIM within this specified period, it may expire and cannot be reactivated.
9. PRICES AND PROMOTIONS
SIMzip’s eSIM packages and services may occasionally be subject to promotional prices, which can change without notice. These promotions run for a specified period and may impose additional conditions. Prices for business users may differ from those for individual customers. SIMzip reserves the right to modify or discontinue any promotion at its sole discretion.
10. USER LOCATION TRACKING
SIMzip does not actively collect or track your personal real-time location data. However, we do maintain information regarding eSIM connectivity at a country and mobile operator level (e.g. which networks are supported and where coverage is available). This ensures you have accurate, up-to-date information about connectivity options without revealing or storing your personal location.
11. LOCAL REGULATORY COMPLIANCE
You agree to comply with any local requirements when using a SIMzip eSIM, which may include registering your device or providing personal data to local authorities if required. You authorise SIMzip to undertake any legally mandated actions on your behalf to ensure regulatory compliance, in accordance with applicable privacy laws.
12. REPRESENTATIONS AND WARRANTIES
By creating an Account and using SIMzip Services, you represent that you are at least 18 years of age (or of the required age of majority in your jurisdiction), and you have the legal capacity to enter into these Terms. If you act on behalf of an entity, you warrant that you have authority to bind that entity to these Terms.
You further represent that your use of the Services will not violate any laws or regulations. You must not engage in any activity that violates the rights of SIMzip or third parties, or that compromises the security or functionality of the Services. Any attempt to misuse, reverse-engineer, or disrupt SIMzip’s operations is prohibited.
13. TERMINATION AND SUSPENSION
You or SIMzip may terminate this Agreement at any time without cause. You may cancel your Account via the Site, App, or by contacting support. SIMzip may terminate or suspend your access if we reasonably believe you have breached these Terms or engaged in fraudulent activity. On termination, SIMzip may delete your data in accordance with our retention policies. Sections intended to survive termination (e.g. disclaimers, liability limits) will remain in full force.
14. LINKS TO THIRD-PARTY WEBSITES
SIMzip may provide links to third-party sites. Such links are for reference only and do not imply endorsement. We do not control or assume liability for any external content. You should review the terms and privacy policies of linked websites carefully. Your use of any linked website is at your own risk.
15. INTELLECTUAL PROPERTY RIGHTS
All content in the SIMzip Services (e.g. text, graphics, logos, software) is owned by or licensed to TELE1 Ltd (SIMzip) and is protected by applicable intellectual property laws. SIMzip is a registered trademark of TELE1 Ltd (Trademark Number: UK00004173849). You may not copy, modify, distribute, or reverse-engineer any material without explicit permission. Your suggestions, ideas, or feedback regarding SIMzip may be used by us without obligation or compensation to you.
16. COPYRIGHT COMPLAINTS
If you believe any content on the SIMzip Services infringes your intellectual property rights, please notify us in writing, including sufficient details of the alleged infringement, at our contact address in Section 27. We will promptly review and address valid notices in accordance with applicable law.
17. CONFIDENTIAL INFORMATION
You acknowledge that certain information provided by or obtained through SIMzip may be considered confidential. You agree not to disclose or use such information for purposes beyond fulfilling your obligations under these Terms. Upon termination, you must return or destroy any confidential information in your possession.
18. DISCLAIMER OF WARRANTIES
SIMzip provides the Services “as is” and “as available,” without any guarantee or warranty of uninterrupted or error-free service. To the fullest extent permitted by law, we disclaim all warranties (express, implied, or statutory) with respect to the Services, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
19. LIMITATION OF LIABILITY AND INDEMNITY
To the maximum extent allowed by applicable law, SIMzip, its officers, employees, and affiliates are not liable for any indirect, incidental, punitive, or consequential losses that arise from your use of the Services. In no event shall our liability exceed the total amount paid by you to SIMzip in the six (6) months preceding the claim.
You agree to indemnify and hold harmless SIMzip and its affiliates from and against any losses, claims, or liabilities arising out of your breach of these Terms or misuse of the Services.
20. DISPUTE RESOLUTION AND GOVERNING LAW
These Terms and any disputes arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales. Both parties irrevocably submit to the exclusive jurisdiction of the English courts.
If any disagreement arises, you agree to first contact SIMzip to resolve the dispute informally. Should no resolution be reached, you and SIMzip agree that any legal action shall take place in an English court. You acknowledge and agree that, to the fullest extent permitted by applicable law, no class or collective actions may be brought against SIMzip, and any dispute must be pursued on an individual basis.
21. NO AGENCY OR EMPLOYMENT RELATIONSHIP
Nothing in these Terms creates or shall be deemed to create any agency, partnership, or employer-employee relationship between you and SIMzip. You are solely a user of the Services, and we do not act as your agent or vice versa.
22. SEVERABILITY AND LANGUAGE
If any provision in these Terms is held invalid or unenforceable, the remaining provisions will continue in full force. Any ambiguity shall be interpreted so as to uphold the intention of the parties. In the event of any inconsistency between a translated version of these Terms and the English version, the English version prevails.
23. ASSIGNMENT
You may not assign or transfer any rights or obligations under these Terms without SIMzip’s prior written consent. We may assign or transfer our rights and obligations to an affiliate or in connection with a merger, acquisition, corporate restructuring, or sale of assets.
24. CHANGES TO THIS AGREEMENT
We reserve the right to revise or modify these Terms at our discretion, with or without notice. Any changes will be posted on the SIMzip Site or within the SIMzip App. Your continued use of the Services after such changes constitute acceptance of the modified Terms.
25. NO THIRD-PARTY RIGHTS
Nothing in these Terms creates rights or benefits enforceable by any person who is not a party to them.
26. NOTICES
You consent to receiving legal and other notices from us electronically. We may provide such notices by email or by posting them on the Site or App. Where we require notices from you, please send them to the contact details in Section 27, unless we specify otherwise.
